1    Definitions
1.1 ‘We’, ‘our’ and ‘company’ means, Wirral Photography & Arts Limited trading as Fast Course Photography. Registered office, The Foundry       Business Centre, Marcus Street, Birkenhead, Wirral, Merseyside CH41 1EU.
1.2 ‘You’ and ‘customer’, means the person enrolling on a course or making an enquiry with the company.
1.3 ‘Course’, means the beginner's photography course.


Enrolment, Pricing & Payments
2.1 All prices quoted are in GBP (Great British Pounds).
2.2 Quotations are made inclusive of applicable taxes, the company reserves the right to increase the amount of any quotation should there be any increase or implementation of applicable taxes between the quotation date and the supply of the course.
2.3 Enrolment requires an email address for the customer. By making a booking, the customer accepts the company’s terms of business. 
2.4 Payment is required prior to the enrolment being approved and the customer being able to access the course materials. Payment can be made by bank transfer and for some services, voucher.
2.5 All enrolment communication should be made in writing, by email. 


3 Customer Obligations
3.1 Our optional support package may involve the customer sending images to us via email, for training and instruction. The customer agrees that they will not email or upload to our website any image or statement that could be reasonably considered to be immoral, offensive, indecent, or which infringes the intellectual property rights of others.
3.2  The course materials must not be used in any unlawful way.

3.3 The customer must not attempt to access any materials that they are not authorised to access.

3.4 The customer must not provide their log in details to any other person to access the course materials. If such a breach occurs, the company will immediately terminate access to the course and any other course provided by us, without refund or compensation.

3.5 Some of the photography techniques may involve some personal risk to safety. It is the responsibility of the customer to ensure a risk assessment is carried out and that they are competent to use the techniques safely. If there is any doubt regarding your ability to employ any technique safely, the technique(s) should not be attempted. No responsibility is accepted for any damage to property, injury or death, however caused.


4 Course Access & Content
4.1 We reserve the right to suspend access to the course for periods of site maintenance or updating of course content. These periods will be kept to a minimum duration, but we are unable to provide notice of such events.
4.2 We endeavour to provide course materials that are accurate and correct. However, there are often several methods that can be employed for specific results and therefore, some of our methods and techniques are based on the views of our authors.

4.3 To access the course, you should sign up on any page that allows this. You should enter your email address and set a password. Provided you have made payment or provided all voucher codes, your account will be approved as soon as possible. Most accounts are approved within 48 hours, but there may be periods when this can take longer.


5 Online Support Subscription
5.1 If you have opted for an online support subscription, the date of activation will be the day after we provide access to your support.
5.2 Two options for online support are available. You can pay per support ticket submission, by monthly standing order or by block time periods of 6 and 12 months.

5.3 Online support subscriptions paid by standing order will remain active unless cancelled by the customer. We will not refund any period regardless of whether the service has been used or not.

5.4 We reserve the right to change the subscription rates at any time. Pre-paid block time will remain unchanged once purchased.

6 Cancellation & Changes
6.1 Cancellations are not accepted after the customer's account has been approved and access to course materials are made possible or, if payment is made with a voucher, once the voucher has been redeemed.
6.2 In the unlikely event that we are unable to provide the course, our liability will be limited to a refund of monies already paid. No consequential claims or other expenses will be accepted. We will not provide refunds if the course materials have been available to you for a cumulative period of 8 weeks or more. We will not provide direct refunds where the course has been purchased using a voucher. If payment was made using a voucher, the refund request must be made to the issuer of the voucher.
6.3 We accept no responsibility for failures of any computer, internet service provider or software used or needed to access the course materials and refunds are not permitted for such events.

7 Copyright
7.1 The company images and text content are owned by the company, their website provider or used under licence and subject to copyright legislation. Course materials must not be used in connection with any commercial activity. Images must not be used for any purposes. 

8 Force Majeure 
8.1 The company shall not be liable for any costs or expenses as a result of events or acts that are outside our reasonable control or would be regarded as being an ‘act of god’. Such events include, but are not limited to: natural disasters, government sanctions / restrictions of movement, war, lockdown, industrial disputes, strikes, infectious disease, pandemics, virus / biotech disasters, leakage or spillage of nuclear / hazardous items, biological / chemical warfare, electronic virus attacks, telecommunication network failures or website hosting failures.


9 Limitations
9.1 The company liability to the customer shall not exceed the total of monies paid by the customer.

10 Conduct

10.1 Customers are expected to treat our staff with respect. We will not tolerate any behaviour that is abusive, threatening, rude, involves unwanted physical contact, or risks damage to equipment. Any illegal act such as the use of drugs or inappropriate behaviour will entitle us to withdraw our services for which there will be no entitlement to compensation or refund.

10.2 Should a customer make or send threatening, intimidating, menacing or abusive emails, letters, texts, online posts or phone calls, we will immediately cease all further communication with them. Communication can then only proceed through a solicitor appointed by the customer at their own expense. Any unacceptable communications, including those from persons acting for the customer will be made available to the police if we deem it appropriate. We will also terminate any course membership without notice or refund.


11 General
11.1 The governing law in the event of a dispute shall be England, United Kingdom.
11.2 No responsibility is accepted for any personal accident or property damage, however caused.
11.3 The company reserves the right to vary these terms without notice.
11.4 Any term that is deemed to be unenforceable, shall not prevent all other clauses from being enforced.
11.5 We welcome positive reviews. Any review that we believe to be untrue or unfair may result in suspension of your access to the course.
